According to the tree’s legal team, the RCMP officers have been using the tree as a urinal almost every day for the last six years. The tree alleges that constantly being soaked in urine has caused irreparable damage to its bark and root system.
“This is a clear case of tree abuse,” said the tree’s lead attorney, Giovanni Battista Francesco Antonio Rossi di Montelera. “We have witness testimony and photographs that clearly show the officers using the tree as their personal toilet without any regard for the tree’s well-being.”
The tree is seeking compensation for damages and an injunction to prevent the RCMP from using it as a urinal in the future.
“We hope that this lawsuit will send a message to all police officers that trees are not to be treated as mere objects,” said Mr. Battista Francesco Antonio Rossi di Montelera. “They are living beings with feelings and rights, just like humans.”
The Kelowna RCMP has yet to comment on the lawsuit, but it is expected to be a lengthy and contentious legal battle.
